Supporting our clients through Probate

Have you been named as an executor? Has a loved one died with or without leaving a Will? Or do you simply want some advice on your own estate to ease the future burden on your family?

When our clients experience a bereavement, we understand dealing with the legal and financial aspect of a loved one’s estate can be stressful and the smallest of tasks can seem overwhelming, if not impossible to manage.

Here at Creaseys we have a dedicated team which has the knowledge and expertise to provide you with a seamless service. We understand that this is a difficult time for our clients and we are able to guide you through both the legal and tax matters with compassion, empathy and trust. Our Probate team here at Creaseys is approved by ICAEW, and specialise in assisting clients with as much of the Probate process as they need.

Probate is the legal process used to administer the estate of a deceased person in accordance with their Will. Being an executor can be a confusing and time-consuming responsibility and its complexity will depend on the nature of the deceased’s estate. We can ease that burden by advising you on all aspects of the process, which can include:

  • Reviewing the deceased’s Will to determine how their assets are to be distributed.
  • Advising on the rules of intestacy should the deceased die without a Will.
  • Advising on post death deeds of variation.
  • Instructing our in-house valuations team to value business assets and shareholdings for inheritance tax purposes.
  • Ensuring that valuable reliefs are correctly claimed such as Business Property Relief (“BPR”), Agricultural Property Relief (“APR”) and the Residence Nil Rate Band (“RNRB”).
  • Looking at the estate’s Inheritance Tax Liability to ensure all other reliefs and exemptions are claimed.
  • Preparing the Inheritance Tax forms and providing you with payment and filing information in a simple and straightforward way.
  • Preparing the application for the Grant of Probate/Letters of Administration.
  • Advising on lifetime tax planning and offering guidance to surviving family members.
  • Insurance cover up to £25,000 – which will cover fees and expenses incurred should HMRC open an enquiry.

At Creaseys we pride ourselves on delivering value to our clients no matter whether you require our full Probate service or just a helpful hand. Not only can we provide you with advice on potential tax savings, we can also offer you reassurance at a stressful time.
